Terms

The agreement between you and Emily Creates LLC for using Backdrop. Short, and in plain words.

Using Backdrop

Backdrop is software for photographers: keep your locations in one place, and share one link with the people you photograph. By creating an account you agree to these terms and to the privacy policy. You need to be old enough to enter a contract where you live.

Keep your password to yourself — anything done from your account counts as done by you.

Backdrop is only software you use to run your own business. Emily Creates LLC is not your employer, agent, or booking service, is not a photographer, and is not a party to the shoots, fees, or agreements between you and the people you photograph. What you arrange with a client is between the two of you.

Your work stays yours

The photographs, location notes, and guide books you upload remain yours. You give us only the permission we need to run the product: to store your files and to display them on your own page and anywhere you have chosen to list them.

Only upload work you have the right to upload, and only share locations you are permitted to share.

The people you photograph

When a client sends you a selection, you receive their name and contact details. Use them to arrange the shoot they contacted you about. Do not add them to a mailing list they did not ask for, and do not pass them on to anyone else. If a client asks you to delete their details, delete them.

The marketplace

Photographers may list guide books for other photographers to buy. When you list one you confirm the locations in it are yours to share, and you grant each photographer who buys it a non-exclusive licence to keep and use a copy of those locations, and the photographs shown with them, in their own work. When you buy one you receive that licence. The licence does not let a buyer re-list, resell, or bulk-share what they bought.

  • Locations you bought from someone else cannot be re-listed for sale.
  • Listings are reviewed before they appear, and we may decline or remove one.
  • Buying and selling guide books is not switched on yet. Nothing in the marketplace charges anyone, and any prices shown are not yet collected. Your Backdrop subscription is separate and is described below.

Your subscription

Backdrop costs $18.99 a month. You give your card when you start a plan, and the subscription renews itself each month until you cancel it. Payments are handled by Stripe — your card number goes to them, not to us, and we never see or store it.

  • Cancel whenever you like, from Profile. Cancelling stops the next renewal; you keep everything until the end of the month you have already paid for.
  • We do not pro-rate part of a month. If something has gone wrong, write to us and we will sort it out rather than hide behind this line.
  • If a payment fails we will retry it and email you. If it keeps failing we pause your public page rather than delete anything, and your locations and photographs stay where they are.
  • If the price changes we will tell you at least 30 days before it affects you, so you can cancel first if you would rather.
  • If you joined while Backdrop was free, nothing starts charging you automatically — we will ask you to choose a plan, and you have to say yes.

Closing your account from Profile deletes your data as described in the privacy policy, and ends the subscription at the same time.

Fees between you and your clients

Your subscription is what you pay Backdrop. It is separate from anything the people you photograph pay you. Location fees you set are an estimate shown to your client and a message to you — Backdrop does not take payment from your clients and is not a party to what you agree with them. Invoicing, deposits, and refunds stay between you and the people you photograph.

What we ask you not to do

  • Upload anything unlawful, or anything you do not have the rights to.
  • Publish someone else's private property or restricted access as though it were open.
  • Try to reach accounts, data, or parts of the service that are not yours.
  • Scrape, resell, or bulk-extract other photographers' locations.

We may suspend or remove an account that does these things. You can close your account whenever you like, from Profile.

Availability, and the honest disclaimer

We work to keep Backdrop running and your data safe, but the service is provided as is: we cannot promise it will never be unavailable, and drive times, travel zones, and map positions are estimates rather than survey data. Keep your own copy of work you cannot afford to lose — Download my data in Profile exists for exactly that.

To the extent the law allows, Emily Creates LLC is not liable for indirect or consequential losses arising from your use of the service.

Changes and contact

If these terms change materially we will update this page and the date above, and ask you to accept the new version the next time you sign in. Anything unclear, reach us from Profile → Help or at info@emilysharonphoto.com.
